Establishment of the Office of Government Procurement Review | ||

In order to promote the processing of complaints on government procurement, the Office of Government Procurement Review shall be established inside the Cabinet Office, and the Government Procurement Review Board shall be established inside the Office. The Board will commence processing complaints on January 1, 1996 as follows. | ||
1. | Office of Government Procurement Review | |
(1) Duties | ||
The Office of Government Procurement Review (hereinafter referred to as "the Office") shall implement the challenge procedures provided for in Article XX of the Agreement on Government Procurement formulated in Marrakech on April 15, 1994 (hereinafter referred to as "the Agreement"). It shall also promote the review of complaints concerning procurement procedures by the central government entities and other central government-related entities to enhance the transparency, fairness and competitiveness of government procurement procedures in Japan. | ||
(2) Composition | ||
The Office shall be composed of the following members. The Chair may, however, appoint additional members when deemed necessary. | ||

(3) Executive Meeting | ||
The Office shall have an executive meeting composed of public service staff from the administrative agencies concerned nominated as secretaries by the Chair, with the Deputy Director General of the Cabinet Office as the head of the meeting. The head of the Executive Meeting shall attend meetings of the Office. | ||
(4) Coordination with the Committee for Drawing Up and Promoting the Action Program | ||
The Office shall coordinate with the Committee for Drawing Up and Promoting the Action Program to promote the processing of complaints on government procurement. | ||
(5) Other Items | ||
The Chair shall determine all other matters necessary for the operation of the Office. | ||
2. | The Government Procurement Review Board | |
(1) Aim | ||
The Government Procurement Review Board (hereinafter referred to as "the Board") shall review complaints filed with respect to procurement by the central government entities and other central government-related entities impartially and independently with reference to the procurement procedures set forth by the Agreement, the applicable measures designated separately by the Chair as well as in compliance with the complaint review procedures adopted by the Office. | ||
(2) Composition | ||
The Board shall consist of people with academic backgrounds in government procurement. Members shall be appointed by the Chair. | ||
(3) Other Items | ||
The Chair shall separately determine any procedures and/or rules necessary for the operation of the Board. | ||
(4) Transitional Measures | ||
In addition to its original aims, the Board shall, for the meantime, process complaints as the Procurement Review Committee stipulated in "Additional Measures of the Government of Japan Relating to Major Projects Arrangements" (Cabinet Decision, July 26, 1991). |
