Disaster Countermeasures Basic Act

Chapter II. Organizations for Disaster Prevention
Section I. Central Disaster Prevention Council
(Establishment of the Central Disaster Prevention Council and Work Administered)
Article 11
The Central Disaster Prevention Council shall be established inside the Cabinet Office.
2. The Central Disaster Prevention Council shall administer the following work:
i.Create and promote the implementation of the Basic Disaster Management Plan,
ii. Create and promote the implementation of plans for emergency measures in the event of a disaster,
iii. Deliberate important matters related to disaster preparedness in response to inquiries from the Prime Minister,
iv. Express its opinions on important matters stipulated in the preceding Item to the Prime Minister,
v. Deliberate important matters related to disaster preparedness in response to the inquiries on the work carried out by the Minister(s) of State for Special Missions stipulated in Paragraph 1 of Article 9 of the Cabinet Office Establishment Law (limited to he/she or those responsible for carrying out, as required by the stipulations in the Paragraph, the work that concern matters stipulated in Item 7 or 8 of Paragraph 1 of Article 4 of said Law and related work stipulated in Paragraph 3 of said Article, hereinafter referred to as "Minister of State for Disaster Management"),
vi. Express its opinions to the Minister of State for Disaster Management on important matters in the preceding Item concerning the work carried out by the aforementioned Minister of State for Disaster Management as required,
vii. In addition to the stipulations in the preceding Items, administer the work that falls under its authority as stipulated by law.
3. The opinions, which are presented by the Central Disaster Prevention Council in response to inquiries from the Minister of State for Disaster Management in accordance with the stipulations in Item 5 of the preceding Paragraph, shall be directed to the Minister of State for Disaster Management who is responsible for carrying out the work that concern the matters included in the aforementioned inquiries. In the case where the post of Minister of State for Disaster Management is not established inside the Cabinet, such opinions shall be directed to the Prime Minister.
4.The Prime Minister shall inquire the Central Disaster Prevention Council on the following matters:
i. Basic policies on disaster management,
ii. Important matters for the overall coordination of disaster management measures,
iii. Outline of emergency measures needed on an interim basis in the event of an emergency,
iv. Proclamations for emergency situations,
v. Other important matters concerning disaster management deemed necessary by the Prime Minister.


(Organization of the Central Disaster Prevention Council)
Article 12
The Central Disaster Prevention Council shall be comprised of members and a Chair.
2.The Prime Minister shall be assigned to the position of Chair.
3.The Chair shall preside over Council affairs.
4. In the case where the Chair is involved in an accident, a member designated in advance shall serve as the proxy.
5. The following shall be assigned as members:
i.Minister of State for Disaster Management
ii. Ministers of ministries and heads of agencies, representatives of designated public institutions and experts appointed by the Prime Minister
6. The Central Disaster Prevention Council may appoint experts for the examination of items that require expertise.
7. The experts shall be appointed by the Prime Minister from the staff of the administrative agencies concerned and designated public institutions as well as those with academic background in the field.
8. A Secretary shall be appointed inside the Central Disaster Prevention Council, and the Secretary shall be a staff member at the Cabinet Secretariat or head of or staff member at a designated public institution (excluding ministers of ministries and heads of agencies) appointed by the Prime Minister.
9. The Secretary shall assist the Chair and members with the work administered by the Central Disaster Prevention Council.
10. Necessary matters concerning the organization and operation of the Central Disaster Prevention Council other than those stipulated in the preceding Paragraphs shall be determined by cabinet order.
